A Virginia pharmacist may substitute a generic equivalent unless the prescriber has written “brand medically necessary” on the prescription or indicated it electronically. The pharmacist must tell the patient about the substitution and record the product dispensed. A patient may ask for the brand and pay for it. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between Virginia pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Virginia requires opioid prescriptions to be electronic, with exceptions, but not non-controlled prescriptions.
Controlled substances
Virginia schedules gabapentin as a Schedule V controlled substance, so gabapentin prescriptions carry the refill, transfer and reporting rules of a controlled drug and are reported to the Prescription Monitoring Program, which prescribers must check before prescribing most controlled substances. First opioid prescriptions for acute pain are limited to seven days, with exceptions. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
Virginia pharmacists may dispense naloxone under a statewide standing order, administer vaccines, and initiate treatment for certain conditions under protocols set by the board, which have broadened in recent years; check the board for the current list. Virginia had not granted pharmacists general authority to prescribe hormonal contraception when this guide was checked. Services vary by pharmacy.
Insulin and cost-sharing caps
Virginia caps cost-sharing for insulin on state-regulated health plans at a fixed amount per thirty-day supply, under a law in force since 2021 and lowered since; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies.
Veterinary prescriptions
Gabapentin is a controlled substance in Virginia, so a veterinary gabapentin prescription for a dog or cat has limited refills, cannot be transferred freely between pharmacies and is reported to the Prescription Monitoring Program under the owner. The Virginia Board of Veterinary Medicine requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request.
