Pharmacy rules in Texas
Texas allows generic substitution unless the prescriber writes that the brand is necessary, requires controlled-substance prescriptions to be electronic, caps insulin cost-sharing on state-regulated plans, and has a board of pharmacy with a straightforward public licence lookup.

A Texas pharmacist may substitute a generic equivalent unless the prescriber has written “brand necessary” or “brand medically necessary” on the prescription, or indicated the equivalent electronically. The pharmacist must tell the patient that a less expensive generic is available and may be substituted, and the patient can refuse the substitution and pay the brand price. The substituted product must be therapeutically equivalent on the FDA’s list, and interchangeable biological products may be substituted under the same rules with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions in Texas can be transferred between pharmacies without limit through pharmacist-to-pharmacist or electronic transfer; the receiving pharmacy initiates it. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Texas does not require non-controlled prescriptions to be electronic, so paper prescriptions remain common for them.
Controlled substances
Texas requires prescriptions for controlled substances to be issued electronically, with limited exceptions, and prescribers and pharmacists must check the Texas Prescription Monitoring Program before prescribing or dispensing opioids, benzodiazepines, barbiturates and carisoprodol. Opioid prescriptions for acute pain are limited to a ten-day supply with no refills. Gabapentin is not scheduled in Texas as of this guide’s date, but it is reported to the monitoring program. Schedule II prescriptions cannot be refilled; a Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
Texas pharmacists may dispense naloxone under a statewide standing order and may administer vaccines. Texas has not granted pharmacists authority to prescribe hormonal contraception; collaborative practice agreements with physicians allow some drug therapy management in specific settings. Ask the pharmacy which services it offers.
Insulin and cost-sharing caps
Texas caps insulin cost-sharing on state-regulated health plans at a set amount per thirty-day supply, under a law in force since 2022; it does not apply to self-funded employer plans, which are federally regulated, or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a Texas pharmacy under the same rules as any outside prescription; the electronic requirement for controlled substances applies to veterinarians as well, with exceptions. The Texas Board of Veterinary Medical Examiners requires a valid veterinarian-client-patient relationship before any prescription, and veterinarians provide prescriptions on request so that clients may fill them elsewhere.
