Pharmacy rules in North Dakota
North Dakota is the only state that requires most pharmacies to be majority-owned by pharmacists, which is why its pharmacy landscape is dominated by independents. It schedules gabapentin as a controlled substance, caps insulin cost-sharing under a 2025 law, and does not let pharmacists prescribe contraception.

A North Dakota pharmacist may substitute a less expensive generic equivalent unless the prescriber has indicated on the prescription, or electronically, that the brand is required. The pharmacist must tell the patient about the substitution, and the patient may refuse it and pay for the brand. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between North Dakota pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. North Dakota schedules gabapentin as a Schedule V controlled substance, so gabapentin prescriptions carry the refill, transfer and reporting rules of a controlled drug and are reported to the state’s Prescription Drug Monitoring Program, run by the Board of Pharmacy. Opioid prescribing for acute pain follows state rules that favor short initial supplies. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
North Dakota pharmacists may dispense naloxone, administer vaccines, and manage drug therapy under collaborative agreements with physicians. North Dakota does not let pharmacists prescribe hormonal contraception. Because most pharmacies are owned by pharmacists, services and hours vary from store to store.
Insulin and cost-sharing caps
North Dakota caps cost-sharing for insulin and certain basic diabetes supplies on state-regulated health plans at a low fixed amount per thirty-day supply, under a 2025 law that extended an earlier cap for state employees; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans.
Veterinary prescriptions
Gabapentin is a controlled substance in North Dakota, so a veterinary gabapentin prescription for a dog or cat has limited refills, cannot be transferred freely between pharmacies and is reported to the monitoring program under the owner. The North Dakota Board of Veterinary Medical Examiners requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request.
