Pharmacy rules in New York
New York requires generic substitution unless the prescriber signs the dispense-as-written box, was the first state to require all prescriptions to be electronic, and has eliminated insulin cost-sharing on state-regulated plans. Pharmacy is regulated by the State Education Department’s Office of the Professions rather than a stand-alone board.

New York requires a pharmacist to substitute a less expensive generic equivalent unless the prescriber has indicated “dispense as written” in the box provided on the prescription or electronically. The pharmacist must tell the patient about the substitution. A patient may ask for the brand and pay for it. The state publishes its own list of substitutable drugs based on the FDA’s therapeutic equivalence ratings, and interchangeable biological products follow similar rules with notice to the prescriber.
Moving a prescription between pharmacies
New York has required almost all prescriptions, controlled and non-controlled, to be transmitted electronically since 2016, with limited exceptions such as veterinary prescriptions and certain hardships. Non-controlled prescriptions can be transferred between pharmacies without a state limit. Refills on a non-controlled prescription are valid for a year. Pharmacies may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows.
Controlled substances
New York’s Prescription Monitoring Program Registry must be consulted by prescribers before prescribing most controlled substances, and pharmacists must report dispensing. Opioid prescriptions for acute pain are limited to a seven-day supply. New York’s own controlled-substance schedules differ from the federal ones in places, so a drug’s refill and prescription rules can be stricter here than elsewhere; the Bureau of Narcotic Enforcement publishes them. Gabapentin is not scheduled in New York as of this guide’s date. Schedule II prescriptions may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
New York pharmacists may dispense naloxone under a standing order, administer vaccines, and, under a law that took effect in 2024, dispense hormonal contraception under a standing order without a separate prescription. Collaborative practice is more limited than in some states. Ask the pharmacy which services it offers.
Insulin and cost-sharing caps
New York eliminated patient cost-sharing for insulin on state-regulated health plans under a law effective in 2025, so insured patients on those plans pay nothing at the counter; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. Cash-paying patients should compare pharmacies and check manufacturer programmes.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a New York pharmacy under the same substitution rules; veterinary prescriptions are exempt from the electronic-prescribing requirement, so paper prescriptions from vets are normal. New York’s veterinary practice rules require a veterinarian-client-patient relationship, and veterinarians provide prescriptions on request.
