Pharmacy rules in New Mexico
New Mexico has some of the broadest pharmacist prescribing in the country, including a pharmacist clinician license and a statewide protocol for contraception, caps insulin cost-sharing on state-regulated plans at one of the lowest levels anywhere, and requires a check of its monitoring program before many controlled prescriptions.

A New Mexico pharmacist may substitute a less expensive generic equivalent unless the prescriber has indicated on the prescription, or electronically, that the brand is required. The pharmacist must tell the patient about the substitution, and the patient may refuse it and pay for the brand. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between New Mexico pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Check the board for the current electronic-prescribing requirements for controlled substances.
Controlled substances
New Mexico’s Prescription Monitoring Program, run by the Board of Pharmacy, must be checked by prescribers before prescribing opioids and some other controlled substances for more than a short period, and pharmacies report every controlled dispensing. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. Gabapentin was not scheduled in New Mexico when this guide was checked. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
New Mexico licenses pharmacist clinicians, who may prescribe under a supervising physician’s protocol, and lets pharmacists prescribe hormonal contraception, including emergency and non-hormonal methods, under a statewide protocol in place since 2017; pharmacists may also prescribe naloxone, smoking-cessation products and HIV prevention medicines under protocols, and administer vaccines. Each service depends on the pharmacy offering it, so ask.
Insulin and cost-sharing caps
New Mexico caps cost-sharing for insulin on state-regulated health plans at a low fixed amount per thirty-day supply under a 2020 law; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a New Mexico pharmacy under the same rules as any outside prescription. The New Mexico Board of Veterinary Medicine requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request.
