Pharmacy rules in New Hampshire
New Hampshire caps insulin cost-sharing on state-regulated plans, has authorized pharmacist-provided contraception under a statewide protocol, requires a check of its monitoring program before many opioid prescriptions, and regulates pharmacy through the Office of Professional Licensure and Certification.
New Hampshire Board of Pharmacy (Office of Professional Licensure and Certification): licence lookup and complaintsGeneric substitution
A New Hampshire pharmacist may substitute a less expensive generic equivalent unless the prescriber has indicated on the prescription, or electronically, that the brand is required. The pharmacist must tell the patient about the substitution, and the patient may refuse it and pay for the brand. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between New Hampshire pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Check the board for the current electronic-prescribing requirements for controlled substances.
Controlled substances
New Hampshire’s Prescription Drug Monitoring Program collects every controlled dispensing, and prescribers must check it before prescribing opioids in most situations. Opioid prescribing for acute pain is limited by state rules that favor short initial supplies. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. Gabapentin was not scheduled in New Hampshire when this guide was checked. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
New Hampshire has authorized pharmacists to provide hormonal contraception under a statewide protocol; check the board for when and how the protocol is in effect. Pharmacists may also dispense naloxone, administer vaccines, and manage drug therapy under collaborative agreements. Services vary by pharmacy.
Insulin and cost-sharing caps
New Hampshire caps cost-sharing for insulin on state-regulated health plans at a fixed amount per thirty-day supply under a 2020 law; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a New Hampshire pharmacy under the same rules as any outside prescription. The New Hampshire Board of Veterinary Medicine requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request.
