Pharmacy rules in Nebraska

A Nebraska pharmacist may substitute a less expensive generic equivalent unless the prescriber has indicated on the prescription, or electronically, that the brand is required. The pharmacist must tell the patient about the substitution, and the patient may refuse it and pay for the brand. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between Nebraska pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Check the board for the current electronic-prescribing requirements for controlled substances.
Controlled substances
Nebraska’s Prescription Drug Monitoring Program is unusual in collecting every dispensed prescription, controlled or not, so prescribers and pharmacists can see a patient’s full dispensing history; it is checked before prescribing opioids and other controlled substances. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. Gabapentin was not scheduled in Nebraska when this guide was checked, though, like every prescription there, it is recorded in the monitoring program. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
Nebraska pharmacists can provide hormonal contraception and manage other drug therapy under collaborative practice agreements with prescribers, and may dispense naloxone and administer vaccines. Each service depends on the pharmacy having the agreement in place, so ask.
Insulin and cost-sharing caps
Nebraska caps cost-sharing for insulin on state-regulated health plans at a fixed amount per thirty-day supply under a 2023 law; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies, which is where comparing pharmacies matters.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a Nebraska pharmacy under the same rules as any outside prescription, and is recorded in the monitoring program like every other prescription. The Nebraska Board of Veterinary Medicine and Surgery requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request.
