Pharmacy rules in Maryland
Maryland allows generic substitution unless the prescriber writes dispense as written, runs a prescription monitoring program that must be checked before many controlled prescriptions, lets pharmacists prescribe contraception, and caps insulin cost-sharing on state-regulated plans.

A Maryland pharmacist may substitute a generic equivalent unless the prescriber has indicated “dispense as written” or the equivalent on the prescription or electronically. The pharmacist must tell the patient about the substitution and pass on the saving; a patient may ask for the brand and pay for it. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between Maryland pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Maryland does not require non-controlled prescriptions to be electronic.
Controlled substances
Maryland’s Prescription Drug Monitoring Program must be checked by prescribers before prescribing most opioids and benzodiazepines, and pharmacies report every controlled dispensing. Opioid prescriptions for acute pain are limited to the lowest effective dose and quantity, with documentation required for longer supplies. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. Gabapentin was not scheduled in Maryland when this guide was checked. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
Maryland pharmacists may prescribe and dispense hormonal contraception after a screening, dispense naloxone under a statewide standing order, administer vaccines, and manage drug therapy under collaborative agreements. Check that the pharmacy participates in each service.
Insulin and cost-sharing caps
Maryland caps cost-sharing for insulin on state-regulated health plans at a fixed amount per thirty-day supply, under a law in force since 2023; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a Maryland pharmacy under the same substitution and transfer rules. The Maryland State Board of Veterinary Medical Examiners requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request so that clients can fill them elsewhere.
