Pharmacy rules in Maine
Maine set some of the earliest statutory limits on opioid prescribing, caps insulin cost-sharing on state-regulated plans, has authorized pharmacist-prescribed contraception, and allows generic substitution unless the prescriber indicates otherwise.

A Maine pharmacist may substitute a less expensive generic equivalent unless the prescriber has indicated on the prescription, or electronically, that the brand is required. The pharmacist must tell the patient about the substitution, and the patient may refuse it and pay for the brand. Substitution follows the FDA’s therapeutic equivalence list, and interchangeable biological products may be substituted with notice to the prescriber.
Moving a prescription between pharmacies
Non-controlled prescriptions can be transferred between Maine pharmacies without a state limit on transfers. Refills are valid for a year from the date written. A pharmacist may dispense up to a ninety-day supply of a non-controlled maintenance medicine when the prescription allows. Maine has moved to require controlled-substance prescriptions to be sent electronically; check the board for the current scope.
Controlled substances
Maine’s Prescription Monitoring Program collects every controlled dispensing, and prescribers must check it before prescribing opioids and benzodiazepines in most situations. Under a 2016 law, opioid prescriptions for acute pain are limited to a seven-day supply and total daily opioid doses are capped for most patients, with exceptions. Schedule II prescriptions cannot be refilled; Schedule III to V may be refilled up to five times within six months. Gabapentin was not scheduled in Maine when this guide was checked. A Schedule II prescription may be transferred electronically once under the federal rule.
What a pharmacist can prescribe or furnish
Maine has authorized pharmacists to prescribe hormonal contraception; check the board for when and how that authority is in effect. Pharmacists may also dispense naloxone, administer vaccines, and manage drug therapy under collaborative agreements. Services vary by pharmacy.
Insulin and cost-sharing caps
Maine caps cost-sharing for insulin on state-regulated health plans at a fixed amount per thirty-day supply under a 2020 law; it does not apply to self-funded employer plans or to patients paying cash. The federal Medicare Part D cap applies to Part D plans. For cash-paying patients no cap applies.
Veterinary prescriptions
A veterinarian’s prescription for a human drug is filled by a Maine pharmacy under the same rules as any outside prescription. The Maine Board of Veterinary Medicine requires a veterinarian-client-patient relationship before prescribing, and veterinarians provide prescriptions on request so that clients can fill them elsewhere.
