    Pharmacy rules in California

    California lets a pharmacist substitute a cheaper generic unless the prescriber forbids it, requires almost all prescriptions to be sent electronically, gives pharmacists unusually wide authority to furnish medicines directly, and runs one of the most active boards of pharmacy in the country.

    Generic substitution

    A California pharmacist may dispense a generic equivalent in place of the brand written on a prescription unless the prescriber has indicated in their own handwriting, or electronically, that no substitution is allowed. The pharmacist must tell the patient that a substitution was made and must note it on the label. A patient who wants the brand can ask for it and pay the brand price. The generic must be on the FDA’s list of therapeutic equivalents, and a pharmacist may also substitute a different dosage form with the same strength and route, such as a tablet for a capsule, unless the prescriber objects.

    Moving a prescription between pharmacies

    California has required prescriptions to be transmitted electronically since 2022, with exceptions for situations such as veterinary prescriptions, emergencies and prescriber hardship, so most patients no longer carry paper. A prescription for a non-controlled drug can be transferred between pharmacies as often as needed, including between unrelated pharmacies, by pharmacist-to-pharmacist communication; the pharmacy you are moving to makes the call. Refills on a non-controlled prescription are valid for a year from the date written. Pharmacies may also dispense a ninety-day supply of a non-controlled maintenance medicine when the prescription allows and the patient has been stabilised on it.

    Controlled substances

    California’s prescription monitoring program is CURES, and prescribers and pharmacists must check it before prescribing or dispensing most controlled substances. Controlled prescriptions must be electronic with limited exceptions. Schedule II prescriptions cannot be refilled; Schedule III to V prescriptions may be refilled up to five times within six months. Gabapentin is not a scheduled drug in California as of this guide’s date, unlike in several other states. A Schedule II prescription may be transferred electronically once, under the federal rule in force since 2023.

    What a pharmacist can prescribe or furnish

    California pharmacists may furnish, without a prescription from another prescriber, self-administered hormonal contraception, naloxone, nicotine replacement products, travel medicines, HIV pre- and post-exposure prophylaxis, and certain vaccines, under protocols set by the board. Pharmacists may also adjust or extend some prescriptions under collaborative practice agreements. Each service is available only at pharmacies that choose to offer it, so ask.

    Insulin and cost-sharing caps

    California had no state insulin copay cap in force as of this guide’s date; a proposed cap was vetoed in favour of the state’s CalRx program to produce low-cost insulin. The federal Medicare Part D insulin cap applies to Part D plans everywhere. For patients paying cash, no cap applies, which is where comparing pharmacies matters.

    Veterinary prescriptions

    A veterinarian’s prescription for a human drug is filled by a California pharmacy under the same substitution and transfer rules as a human prescription, and the electronic-prescribing requirement does not apply to veterinarians. A California veterinarian provides a prescription on request so the client can fill it elsewhere; the Veterinary Medical Board publishes the rules. Compounding for an individual animal follows the board’s compounding regulations and FDA’s guidance for animal drugs.
